Taking place in JW.Marriott Hotel, Jakarta on Wednesday, May 27th 2009, IFCCI organized its Social Business Rendezvous, presenting Mr. Wahyuni Bahar, S.H., LLM, the Founder and Managing Partner of Bahar and Partners.

Mr. Bahar began his presentation about “Protecting Foreign Investment in Indonesia”. by explaining about the new investment Regulation Law No. 25/2007 which simplify the licensing process by offering one-stop service, grant tax-related incentives, grant longer ownership period for land rights, simplify immigration-related process, protect against nationalization, and introducing acknowledged by Indonesian law to foreign arbitration.  

Regarding the negative list, Mr. Bahar has also stated that there are some problems regarding the implementation of the negative list. The first problem is that there are some gray areas in several business lines, which could bring some investment problems where there is several closed business lines listed in the first attachment, meanwhile in another attachment listed as the conditionally opened.
 
The other problem is the application of “Grandfather Clause” or retroactive principle. The Retroactive Principle means that a new regulation made shall not be applicable for cases that already happen in the past, which means if the government changes the negative list; the new provision could not be applied to business made prior to the new regulation.

Mr. Bahar ends his presentation by an analyze weather the Negative List applicable to both Direct Investment and Indirect Investment or portfolio investment, and the analyze shows that indirect investment which shall mean an investment conducted in the Stock Exchange, shall not fall under the new investment Law No.25/2007.

In conclusion he highlighted that even though there are some problems which foreign investment is currently facing, the policy made by the government is getting more supportive towards foreign investment, therefore Indonesia is still a good place to invest and do business.
